Shipping Policy
SimPRO Engineering® will deliver the Products that are the subject of the Order to the Customer through trusted couriers and/or freight forwarders (with tracking information) and/or its own agents to the address provided by the Customer at the time of the online Order.
The Site indicates the availability of the Products and their delivery times, however, due to the complexity of some products, such information is to be considered purely indicative and not binding.
Delivery of the Products is contingent upon payment.
SimPRO Engineering® undertakes to do everything within its power in order to meet the delivery times indicated on the Site.
In case of non-availability of the Product (due to difficulties in procurement and / or problems in the delivery of components by our suppliers) we will provide written notice to the Customer (to the email address provided by the same) and we will refund, if requested, any sums already paid.
Such refunds will be made using the same means of payment used by the Consumer for the initial transaction, unless the Consumer requests a refund on a different means of payment, in which case any additional costs arising from the different means of payment will be borne by the Consumer.
Where the Customer has chosen bank transfer as the method of payment, the delivery period shall commence upon receipt of the consideration.
The shipment of the Products ordered by the Customer will take place in the manner indicated on the Site at the time of placing the Order.
The Customer, upon delivery, agrees to promptly check:
1. That no anomalies such as damage to the packaging or goods are detected in the package/wrapping, and that it is therefore intact and conforms to the standard characteristics of a package/wrapping.
2. That the number of packages indicated on the invoice or the TD corresponds to the number of packages actually delivered.
3. That there are no abnormal openings of the package/wrap (film or tape breakage).
In case of damage to the package, reject the shipment with the following reason:
"DAMAGED GOODS," asking the carrier to open the package with you.
In case you want to accept the goods, on the other hand, it is mandatory to put the following wording: "SPECIFIC RESERVE OF CHECK", then indicating the reason for which you are putting the reserve (e.g. damaged packaging or what you verify). Once you have placed the reserve and requested appropriate receipt or whatever else attests to the report, open the goods. In the case of a breakage, send within 48h photos of the damaged goods by email to sales@simproengineering.com.
WITHOUT TRACEABLE WRITTEN RESERVATION AND IF THE COMMUNICATION OF THE BREAKAGE DOES NOT TAKE PLACE WITHIN 48H, IT WILL NOT BE POSSIBLE TO CLAIM FOR DAMAGES OR SHORTAGES.
Tax documentation will be issued based on the data entered by the Customer when placing the Order.
If the Customer is not a Consumer and unless special exceptions are set forth in the Order Confirmation, the Products shall be deemed to be delivered Ex Works. Unless otherwise agreed they will travel on behalf and at the risk of the Customer even in the case of delivery ex Customer.
SimPRO Engineering® shall not be liable for inefficiencies attributable to force majeure of any nature or kind in the event it fails to execute the requested supply within the time agreed and provided for in this contract. Force majeure causes include, but are not limited to, measures taken by the Public Authority, strikes by its own employees, employees of third party companies or employees of carriers, as well as any other circumstances beyond its control or independent of it.
Return and Exchange Policy
The Customer who has purchased as a Consumer, in accordance with the provisions of the Consumer Code, has the right to withdraw from the sales contract without any penalty and without specifying the reason at any time, providedwithin 14 (fourteen) days from the date of delivery of the Product (hereinafter also called “Withdrawal Period”).
Making use of the right of withdrawal, the Customer must contact Customer Service via email atsales@simproengineering.com communicating the invoice details. In case of partial withdrawal, in addition to the purchase invoice, the Customer must also communicate the code of the purchased Product(s) that he intends to return. Within 48 hours of communication to Customer Service, the Consumer must also send by registered letter with acknowledgment of receipt. to SimPRO Engineering, Via Partigiani d'Italia 8, 13898, Occhieppo Superiore (BI), a written declaration signed by the Consumer himself containing the will to exercise the right of withdrawal, summarizing all the data indicated and requested above.
You will be refunded the payments you have made minus the delivery costs (including additional costs resulting from the possible choice of a type of delivery different from the least expensive type of standard delivery offered) without undue delay. These refunds will be made using the same payment method used by the Consumer for the initial transaction, unless the Consumer requests the refund using a different payment method, in which case any additional costs deriving from the different payment method will be borne by the Consumer.
If the Customer has chosen bank transfer as the payment method, the delivery term will start from receipt of the payment.
The Consumer is responsible for the decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the Products. Therefore, if the returned goods are damaged (for example with signs of wear, abrasion, nicks, scratches, deformations, etc.), not complete with all their elements and accessories (including unaltered labels and tags attached to the product) , not accompanied by the attached instructions/notes/manuals, the original packages and packaging and the guarantee certificate, where present, the Consumer will be liable for the decrease in the value of the Product, and will be entitled to a refund of the amount equal to the residual value of the Product . To this end, therefore, the Consumer is invited not to manipulate the Products beyond what is strictly necessary to establish their nature, characteristics and functioning and to cover the original packaging of the Products with other protective packaging that preserves their integrity and protect it during transport also from writing or labels.
The Consumer is required to return the Products for which he has exercised the right of withdrawal to the address indicated on the Site.
THE REFUND, UPON THE CONSUMER'S DEMONSTRATION THAT THE GOODS HAVE BEEN SENT BACK, IS SUSPENDED UNTIL THE GOODS THESE ARE RECEIVED AND CHECKED.
As provided for by the art. 55 of Legislative Decree 206/2005 Consumer Code, the right of withdrawal does not apply to goods made to measure or clearly personalized and, therefore, these products cannot be withdrawn.
Complaints relating to the guarantee must be made directly by registered mail.
The warranty becomes void if the Customer orders or allows unauthorized persons to carry out repairs, interventions or modifications to the goods or if the same have been used in conditions other than those for which they were built and tested or because alternative material is used. consumption different from that expressly communicated bySimPRO Engineering®.
